The client can offer jobs in the service called JobSurf suplied by Udena Internet at anytime. However, the offers will only be visible to the general user of JobSurf after a written contract has been signed with Udena Internet.

A password will be assigned during the registration process. This password allows the client to start entering job offers immediately. These offers will, however, only be visible to the client. Other users of JobSurf will only see these offers after reception of the signed contract.

Udena Internet provides a service for companies to publish job offers on the Internet for a monthly fee.

Rights and Duties of the Client

The client is responsible for the usage of his identification and password. It is his responsibility to make certain that the password is not given to third parties. If job offers are entered by third parties using his identification and password, Udena Internet reserves the right to bill the client for these offers.

The client is responsible for the content of the jobs entered and agrees to enter no offers with obscene or illegal contents.

The client agrees to immediately notify Udena Internet of any problems, be they faults in the system or job offers with obscene or illegal contents or particularly unauthorised usage of his identification and password by third parties.

The client agrees to inform all his agents of the terms of these conditions and to insure their keeping to these terms.

In the case of unlawful usage of the JobSurf service, Udena Internet has the right of immediate termination of the display of the job offers concerned and, if necessary, cancellation of the account of the offending client. In this case the client will forfeit monies already paid.

The client is responsible for the security of the hardware and software and data that he uses to access the services of Udena Internet. It is his responsibility to ensure that unauthorised third parties have no access.

Rights and Duties of Udena Internet

Udena Internet reserves the right to temporarily interrupt services for necessary maintenance work. Whenever possible, Udena Internet will inform all concerned parties beforehand, however, Udena Internet may, in special cases, interrupt the service without prior notice.

Fees

The fees for the usage of the JobSurf service offered by Udena Internet are as follows:
Each job offer entered will be charged sFr. 70.00 for the first week (7 days), therafter sFr. 10.00 per day for each additional day of display.

Udena Internet can also enter job offers for clients, in which case a one time handling fee of sFr. 50.00 will be charged per offer entered.

Billing is done via invoicing only. Invoices to Swiss companies are sent out on a monthly base and must be paid within a period of 10 days (non Swiss companies, please mail or e-mail for specifics).

Udena Internet reserves the right to immediately cease display of all job offers of the client in case of non payment.

Udena Internet has the right to change the structure of the fees, e.g. raising of prices, after one month notice. It is the duty of the client to check the fees to inform himself of the current pricing structure.

Warranties and Liabilities

Limitation of Liability. UNDER NO CIRCUMSTANCES INCLUDING NEGLIGENCE, SHALL Udena Internet BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OR INABILITY TO USE THE JobSurf service OR RELATED DOCUMENTATION AND DATA, EVEN IF Udena Internet OR AN AUTHORIZED REPRESENTATIVE OF Udena Internet HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. In no event shall Udena Internet's total liability to you for all damages, losses, and causes of action (whether in contract, tort (including negligence) or otherwise) exceed the amount paid by you for one job offer for one week.

Duration of the License

After the reception of a signed contract, Udena Internet will change the status of the client so that all job offers previously entered and all offers entered from that time on using the clients identification and password are visible to the Internet. This service will continue for an indefinite time unless terminated by cancellation of the clients account due to the clients publishing of obscene or illegal job offers.
